Terms of Service

These Terms of Service govern your access to and use of Pitchenza. By creating an account or using Pitchenza, you agree to these Terms. If you do not agree, you should not use the service.

Eligibility and Account Responsibility

You are responsible for maintaining accurate account information, protecting your account credentials, and for all activity conducted through your account. You agree to use Pitchenza lawfully and only for purposes permitted by these Terms.

Acceptable Use

You must not use Pitchenza to:

• Violate any applicable law or regulation
• Impersonate another person or organization
• Engage in fraud or deceptive practices
• Harass, threaten, or harm others
• Distribute malware or harmful code
• Attempt unauthorized access to accounts, systems, or data
• Bypass or circumvent security controls
• Scrape, attack, or otherwise interfere with the operation of the service
• Access another user's account or data
• Use Pitchenza for spam or abusive outreach

Creator Outreach

Pitchenza helps you organize and create outreach, but you remain responsible for your outreach activity. In particular, you are responsible for:

• Deciding who to contact
• Ensuring you have the right to contact someone
• Reviewing messages before sending them
• Complying with applicable marketing, email, privacy, and anti-spam laws
• Honoring the rules of Instagram, TikTok, LinkedIn, email, or any other channel you use

Pitchenza does not guarantee that brands will respond, that a pitch will result in a collaboration, that outreach will be successful, or that you will earn any particular revenue.

AI-Assisted Content

Pitchenza may generate suggested pitches, follow-ups, or other text using AI-assisted features. AI-generated content may be inaccurate, may require editing, and may not be appropriate in every situation.

You are responsible for reviewing any AI-generated content before using or sending it. Pitchenza does not guarantee the accuracy or effectiveness of AI-generated outputs. You remain responsible for the messages you ultimately choose to send.

Your Content

You retain ownership of the content and information you enter into Pitchenza, including pitches, templates, notes, uploaded content, and collaboration information. Pitchenza receives only the limited rights necessary to store, process, display, and operate that content for you as part of providing the service.

Third-Party Services

Pitchenza may connect with or link to third-party services, which may eventually include email services, social platforms, payment services, or AI providers. Pitchenza is not responsible for the independent terms, policies, or availability of those third-party services.

Brand and Third-Party Information

Company names, trademarks, products, and other third-party information belong to their respective owners. Storing a brand inside Pitchenza does not mean that the brand endorses Pitchenza, that Pitchenza represents the brand, or that the brand has a partnership with Pitchenza.

Payments Between Creators and Brands

Pitchenza may help you track money owed by brands. Unless Pitchenza actually processes those payments, Pitchenza is a tracking and organization tool and is not a party to payment agreements between you and a brand.

You and the brand are responsible for contracts, invoices, payment terms, taxes, disputes, and collections. Pitchenza does not guarantee that you will be paid.

Subscriptions and Billing

Pitchenza is currently available at no charge. There are no active paid plans, and no billing occurs today.

Termination

You may stop using Pitchenza at any time and may delete your account using the controls available in Settings. Pitchenza may suspend or terminate accounts for serious violations of these Terms, unlawful activity, security threats, or abuse of the platform.

Service Availability

Pitchenza may change, improve, or discontinue features at any time. The service may temporarily experience downtime or interruptions. We do not guarantee uninterrupted or error-free service.

Disclaimer

Pitchenza provides software tools for organization, outreach management, and creator business workflows. Pitchenza does not guarantee brand partnerships, income, response rates, business success, or payment from brands.

Limitation of Liability

To the extent permitted by applicable law, Pitchenza's liability is limited as is reasonable for a software service of this kind. Pitchenza is not liable for indirect or consequential damages beyond what is reasonable under the circumstances.

Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles.

Changes to These Terms

These Terms may change as Pitchenza evolves. The "Last Updated" date at the top of this page reflects when the Terms were last revised. Continued use of Pitchenza after changes means you accept the updated Terms.
